Introduction to the Case
Jackie Fox from Birmingham, Alabama was diagnosed with ovarian cancer in March of 2013 and passed away in October of 2015. She had filed a civil suit against Johnson & Johnson and claimed that the talc in Johnson & Johnson’s baby powder and their popular Shower to Shower feminine hygiene powder had lead her to develop cancer after several decades of use.
Talc is a naturally occurring mineral that is mainly made up of magnesium, silicon and oxygen. Talc is widely used in cosmetics and personal care products to absorb moisture, reduce friction, prevent caking, and improve the product’s feel.
The Results
At trial, Dr. Daniel Cramer, director of the OB/GYN Epidemiology Center in Brigham and the Women’s Hospital in Boston, and an expert witness who testified on behalf of the plaintiff, said that he had conducted his own study and had found an increased risk of ovarian cancer in women who had used talcum powder products.
The jury for this trial agreed with the Dr. Cramer’s testimony and awarded $10 million in actual damages and $62 million in punitive damages to the plaintiff. The punitive damages were awarded in order to punish Johnson & Johnson due to a letter from September 1997 indicating that the company knew the increased risk of ovarian cancer that was connected with their talcum powder products, which were being marketed as feminine hygiene products.
